Som erkendt af indklagede har indklagede ikke i udbudsbekendtgørelsen anført de kriterier, der ville blive lagt til grund ved vurderingen af projekterne, og indklagede har dermed tilsidesat kravene i Udbudsdirektivets artikel 70, jf. bilag VII D, nr. 7, til indholdet af udbudsbekendtgørelsen. 2. Påstanden tages derfor til følge. ..... K1. Ad påstand 1 Indklagede har handlet i strid med Udbudsdirektivets artikel 70, jf. Da indklagede ikke allerede i udbudsbekendtgørelsen med tilstrækkelig tydelighed havde fastsat, at størrelsen af honorartilbudene ville indgå som et bedømmelseskriterium under projektkonkurrencen, tages påstanden til følge. ..... Indklagede har handlet i strid med Tjenesteydelsesdirektivets artikel 13 og det EU-udbudsretlige gennemsigtighedsprincip ved at tillade, at dommerkomitéen lod tilbudene på honorar for ydelse af teknisk rådgivning og bistand indgå som et bedømmelseskriterium for beslutningen om udvælgelsen af det bedste forslag, uanset at indklagede ikke i udbudsbekendtgørelsen havde fastsat, at dette ville indgå som et kriterium for denne beslutning. |
