    INFORMATION WHICH MUST APPEAR IN DESIGN CONTEST NOTICES
    CONTEST NOTICES
    1. Name, address, fax number and email address of the contracting authority and those of the service from which the additional documents may be obtained
    2. Description of the project
    3. Type of contest: open or restricted
    4. In the event of an open contest: time limit for the submission of projects
    5. In the event of a restricted contest:
    (a) number of participants contemplated
    (b) names of the participants already selected, if any
    (c) criteria for the selection of participants
    (d) time limit for requests to participate
    6. If appropriate, indicate that the participation is restricted to a specified profession
    7. Criteria which will be applied in the evaluation of the projects
    8. Names of any members of the jury who have already been selected
    9. Indicate whether the jury's decision is binding on the contracting authority
    10. Number and value of any prizes
    11. Payments to be made to all participants, if any
    12. Indicate whether any contracts following the contest will or will not be awarded to the winner or winners of the contest

    6. Where applicable, indication of whether participation is reserved to a particular profession.
    7. Criteria to be applied in the evaluation of projects.

    9. Indication of whether the decision of the jury is binding on the authority.

Ad påstand 1
    1. Som erkendt af indklagede har indklagede ikke i udbudsbekendtgørelsen anført de kriterier, der ville blive lagt til grund ved vurderingen af projekterne, og indklagede har dermed tilsidesat kravene i Udbudsdirektivets artikel 70, jf. bilag VII D, nr. 7, til indholdet af udbudsbekendtgørelsen.
    2. Påstanden tages derfor til følge.

    K1. Ad påstand 1 Indklagede har handlet i strid med Udbudsdirektivets artikel 70, jf. Bilag VII, D nr. 7, ved ikke i udbudsbekendtgørelsen at have anført de kriterier, der ville blive lagt til grund ved vurderingen af projekterne.

5. Det følger af Tjenesteydelsesdirektivets artikel 15, stk. 3, jf. artikel 17, jf. bilag IV, punkt IV. 2, at en udbyder, der ønsker at udskrive en projektkonkurrence, skal tilkendegive sin hensigt herom ved en bekendtgørelse. I udbudsbekendtgørelsen skal fastsættes de kriterier, der vil blive anvendt ved evalueringen af projekter.
    6. Dommerkomitéens afgørelser vedtages alene ud fra de kriterier, der er fastsat i bekendtgørelsen i henhold til artikel 15, stk. 3, jf. artikel 13, stk. 6.
    7. Da indklagede ikke allerede i udbudsbekendtgørelsen med tilstrækkelig tydelighed havde fastsat, at størrelsen af honorartilbudene ville indgå som et bedømmelseskriterium under projektkonkurrencen, tages påstanden til følge.

Indklagede har handlet i strid med Tjenesteydelsesdirektivets artikel 13 og det EU-udbudsretlige gennemsigtighedsprincip ved at tillade, at dommerkomitéen lod tilbudene på honorar for ydelse af teknisk rådgivning og bistand indgå som et bedømmelseskriterium for beslutningen om udvælgelsen af det bedste forslag, uanset at indklagede ikke i udbudsbekendtgørelsen havde fastsat, at dette ville indgå som et kriterium for denne beslutning.
