CONTRACT NOTICES
    Open and restricted procedures, competitive dialogues, procedures, negotiated procedures:
    1. Name, address, telephone and fax number, email address of the contracting authority.
    2. Where appropriate, indicate whether the public contract is restricted to sheltered workshops, or whether its execution is restricted to the framework of protected job programmes.
    3. (a) The award procedure chosen;

38. According to the material in the case-file, it appears that the contract at issue in the main proceedings is, if not a supply contract, certainly a mixed supply contract and service contract in which the value of the supply predominates. In that event, the relevant provisions are those of the Community directives on public supply contracts, not those on public service contracts.
    39. For public supply contracts within the scope of Directive 93/36, the content of the contract notice was governed at the material time by the first sentence of Article 9(4) of and Annex IV to Directive 93/36, those provisions having been replaced subsequently by Article 36(1) of and Annex VII A to Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts (OJ 2004 L 134, p. 114) and by Annex II to Commission Regulation (EC) No 1564/2005 of 7 September 2005 establishing standard forms for the publication of notices in the framework of public procurement procedures pursuant to Directives 2004/17/EC and 2004/18/EC of the European Parliament and of the Council (OJ 2005 L 257, p. 1).
    40. The first sentence of Article 9(4) of Directive 93/36 requires that the notices be drawn up in accordance with the models given in Annex IV to that directive and specify the information requested in those models.
    41. The model contract notice in Annex IV provides for reference to the total quantity or scope of the contract (including all lots and options, if applicable).
    42. Consequently, a contract notice concerning a public supply contract within the scope of Directive 93/36 must, in accordance with that directive, state the total quantity or scope of the contract to which it relates.
    43. If, in a specific case, that requirement is not fulfilled, there is an infringement of Community law in the field of public procurement within the meaning of Article 1(1) of Directive 89/665, such as to give rise to a right of review in accordance with that provision.
    44. Consequently, the answer to the second question must be that, in accordance with Article 9(4) of and Annex IV to Directive 93/36, the contract notice concerning a contract within the scope of that directive must state the total quantity or scope of that contract. The absence of such an indication must be capable of being reviewed under Article 1(1) of Directive 89/665.

    2. På grundlag af de foreliggende oplysninger om forløbet hos indklagede den 19. maj 2007 kan Klagenævnet fastslå, at indklagede besluttede at udsætte fristen for modtagelse af tilbud på det fastsatte sted Den Gamle Byrådssal, Rådhuscentret 1, 7190 Billund, for at give tilbudsgiverne 3, 4 og 5, som på grund af en fejl fra deres side måtte antages ikke rettidigt at ville kunne aflevere deres tilbud på det fastsatte sted Den Gamle Byrådssal, Rådhuscentret 1, 7190 Billund, mulighed for alligevel at aflevere deres tilbud på det fastsatte sted rettidigt. Da denne begrundelse ikke er en saglig begrundelse for at udsætte en sådan frist, har indklagede handlet i strid med Tilbudslovens § 3, stk. 1. Klagenævnet tager derfor påstanden til følge.
    3. Klagenævnet har ikke herved taget stilling til, om indklagede – hvis de 3 tilbud på grund af fejl fra tilbudsgivernes side ikke var blevet modtaget rettidigt og derfor skulle afvises – havde haft en saglig grund til at annullere licitationen.
    4. Det bemærkes, at det er uden betydning om de mødte tilbudsgivere forud for, at indklagede traf afgørelse om udsættelse af fristen, accepterede udsættelsen eller protesterede mod udsættelsen, ligesom det er uden betydning om og i bekræftende fald hvornår de mødte tilbudsgivere efterfølgende har protesteret mod beslutningen om udsættelse.

    43. Det følger af det EU-udbudsretlige gennemsigtighedsprincip, at der skal gives en nøjagtig og fuldstændig beskrivelse af det udbudte, jf. Klagenævnets kendelse af 1. marts 1999, Enemærke & Petersen A/S mod Fællesorganisationens Boligforening.
    44. Det er fastsat i punkt II.2.1. i udbudsbekendtgørelsen af 25. juni 2004, at det samlede antal beholdere vil andrage ca. 6000, idet endelige antal vil afhænge af borgernes valg. Det er endvidere fastsat i udbudsbekendtgørelsens punkt II.2.2., at der er mulighed for yderligere levering af beholdere til indklagedes interessentkommuner inden for to år fra datoen for kontraktsindgåelse.
    45. Det fremgår af udbudsbetingelsernes Kontaktbilag 1: Specifikation afsnit 2.1. »Antal beholdere«, 2. afsnit, sammenholdt med Kontraktbilag 2: Tilbudsliste afsnit 2.1. »Tilbud på levering af standard affaldsbeholdere monteret med chip«, at der som vejledende antal skulle leveres 4.415 beholdere til Skanderborg Kommune.
    46. I tabellen i udbudsbetingelsernes Kontraktbilag 1: Specifikation afsnit 2.1 »Antal beholdere« er anført et samlet antal beholdere på 71.800, hvilket svarer til det maksimale antal husstande, der ifølge tabellen skal have leveret beholdere til pap- og papiraffald samt beholdere til dagrenovation, i kommuner, hvortil der »skal leveres«, »forventes at skulle leveres« eller er »mulighed for levering«.
    47. Det samlede antal beholdere, der, i givet fald kunne blive tale om at levere, og sandsynligheden for, at optionerne ville blive gjort gældende, findes med den anførte beskrivelse ikke eller kun med vanskelighed at kunne vurderes.
    48. Klagenævnet finder derfor, at indklagede har handlet i strid med det EUretlige gennemsigtighedsprincip ved at angive leverancens omfang som sket. Klagenævnet har herved lagt vægt på, at leverancens omfang er en væsentlig oplysning for tilbudsgiverne. Indklagede kunne uden vanskeligheder have præciseret, hvad der skulle forstås ved sikre, forventede og mulige leveringer, ligesom indklagede uden vanskeligheder kunne have præciseret, at der ikke skulle leveres en beholder pr. husstand.
    49. Ifølge Indkøbsdirektivets artikel 9, stk. 4, 1. pkt., skal bekendtgørelserne udformes i overensstemmelse med modellerne i bilag IV og skal indeholde de deri krævede oplysninger. Ifølge direktivets bilag IV, udbudsbekendtgørelse, punkt II.2.1. skal angives »Samlet mængde eller omfang (i givet fald inklusiv alle delaftaler og optioner)«.
    50. Klagenævnet finder, at indklagede tillige har handlet i strid med Indkøbsdirektivets artikel 9, stk. 4, 1. pkt., ved at fastsætte i udbudsbekendtgørelsen, at det samlede antal vil andrage ca. 6000, idet det er ubestridt, at 6000 alene omfatter det antal, der skal leveres til Skanderborg Kommune.
    51. Det kan ikke føre til et andet resultat, at indklagede i udbudsbekendtgørelsens punkt II.2.2. har anført, at der er mulighed for yderligere levering til indklagedes interessentkommuner.
    52. Klagenævnet bemærker, at sidstnævnte overtrædelse af Indkøbsdirektivet ikke er uvæsentlig, da den kan have ført til, at mange producenter og forhandlere af affaldsbeholdere, der ville have afgivet bud, hvis den korrekte størrelsesorden for leverancen inkl. optioner var blevet oplyst, har undladt at afgive tilbud.
    53. Påstanden tages derfor til følge.

Et tilbud skal for at kunne tages i betragtning indeholde alle de oplysninger, der er krævet i licitationsbetingelserne, samt de oplysninger, som er nødvendige for, at tilbudet kan evalueres, herunder oplysninger om prisen. I tilknytning hertil bemærkes, at en udbyder i henhold til Tilbudslovens § 7, 2. pkt., har pligt til ved åbningen af tilbudene at gøre de tilstedeværende tilbudsgivere bekendte med tilbudssummerne i de modtagne tilbud. Heraf følger, at tilbudssummen umiddelbart skal kunne udledes af hvert enkelt tilbud.
    6. Ganske vist kan der ikke på denne baggrund i alle tilfælde opstilles et krav om, at tilbudssummen skal være anført med det specifikke, endelige beløb i hvert enkelt tilbud, idet prisen for eksempel kan være sammensat af flere delpriser, der ikke er lagt sammen til en endelig pris, uden at der derved er pligt til at afvise tilbudet.
    7. I den aktuelle sag kunne tilbudssummen i tilbudet fra Benny Hansens Tømrer- og Snedkerforretning ApS vedrørende udførelse af bygge- og anlægsopgaven under anvendelse af parketgulv af typen Parket Evers Tarket Contract imidlertid ikke udfindes ved et simpelt regnstykke. Det var således ikke muligt af licitationsbetingelserne nøjagtigt og entydigt at udlede antallet af m2 med henblik på at udregne fradraget i forhold til prisen for udførelse af opgaven under anvendelse af parketgulv i 22 mm massiv bøg af typen Harmony fra Juncker’s. Indklagedes tekniske rådgiver så sig således også nødsaget til efter åbningen af tilbudene at tage kontakt til Benny Hansens Tømrer- og Snedkerforretning ApS med henblik på at få fastlagt den nøjagtige fradragspris.
    8. Klagenævnet finder derfor, at indklagede har handlet i strid Tilbudslovens § 6, stk. 1, og gennemsigtighedsprincipet ved at have taget tilbudet fra Benny Hansens Tømrer- og Snedkerforretning ApS vedrørende udførelse af bygge- og anlægsopgaven under anvendelse af parketgulv af typen Parket Evers Tarket Contract i betragtning, da hverken fradragsbeløbet på 79.000 4 5 6 7 8 20. kr. eller den endelige pris for udførelse af bygge- og anlægsopgaven under anvendelse af parketgulv af typen Parket Evers Tarket Contract var anført i tilbudet. Påstanden tages derfor til følge.

1. Klagenævnet lægger til grund, at beslutningen om at udsætte åbningen af tilbud blev meddelt tilbudsgiverne – og derved kom til deres kundskab – den 24. marts 2003 kl. 11.02.
    2. MT Højgaard A/S, med hvem indklagede efterfølgende valgte at indgå kontrakt, afleverede efter accept fra indklagede sit tilbud, efter at det tidspunkt for aflevering af tilbud, der var fastsat i licitationsbetingelserne, var indtrådt. Der ses ikke i Tilbudsloven at være hjemmel til at tage tilbud i betragtning, som er indleveret efter den i licitationsbetingelserne fastsatte frist for aflevering af tilbud. Indklagede har således handlet i strid med Tilbudslovens § 5, stk. 2, 1. pkt., jf. § 6, ved at have taget tilbudet fra MT Højgaard A/S i betragtning og efterfølgende besluttet at indgå kontrakt med MT Højgaard A/S. MT Højgaard A/S har således - både i forhold til tilbudsgivere, som havde disponeret således, at de kunne være til stede med henblik på at aflevere deres tilbud rettidigt og i forhold til potentielle andre tilbudsgivere, som måtte være blevet forsinket og derved have valgt at afstå fra at afgive tilbud - fået en fordel i forbindelse med afgivelse af tilbud, derved at indklagede imødekom denne tilbudsgivers ønske om udsættelse.
    Herefter bestemmes:
    K1. Indklagede, Vejle Amt, har handlet i strid med Tilbudslovens § 5, stk. 2, 1. pkt., jf. § 6, ved at tage tilbudet fra MT Højgaard A/S i betragtning, uagtet dette tilbud var afgivet efter udløbet af den i licitationsbetingelserne fastsatte frist for afgivelse af tilbud.

    Det er oplyst, at begge licitationer efter en tilbudsgivers anmodning blev udsat til onsdag den 28. maj 2002, hvor de blev gennemført med de ovenfor nævnte tidsintervaller.

    Påstand 5 Klagenævnet skal konstatere, at indklagede har handlet i strid Tilbudsloven § 4, ved ikke at anvende »samme tidspunkt« for de indbudtes afgivelse af tilbud, bl.a. idet klagerens tilbud i henhold til licitationsbetingelserne var afleveret pr. post senest kl. 9.30 den fastsatte licitationsdato den 27. maj 2002. Ved licitationens start kl. 10.00 fik bl.a. næstlavestbydende udsat afleveringsfristen til næste dag kl. 10.00, idet licitationen blev udsat til dette tidspunkt.]

1. Under hensyn til formålet med, at der i indkøbsdirektivet er fastsat regler om, at det ved offentlige udbud efter dette direktiv i udbudsbekendtgørelsen skal oplyses, hvornår sidste frist for modtagelse af tilbud er, samt hvor og hvornår åbningen af tilbud finder sted, må reglerne forstås således, at kun tilbud, som er tilstede på det sted, hvor åbningen skal finde sted, på det tidspunkt, hvor åbningen skal påbegyndes, kan anses for rettidigt modtaget af udbyderen. Da tilbuddet fra Brønderslev Cementfabrik A/S ikke var tilstede i det lokale på Lager- og Indkøbskontoret, hvor åbningen af tilbud skulle finde sted, da åbningen blev påbegyndt, var kommunen uberettiget til at tage dette tilbud i betragtning. Klagenævnet træffer derfor afgørelse i overensstemmelse med klagernes påstand.
    K1. Herefter bestemmes: Aalborg Kommune handlede i strid med direktiv 93/36/EØF artikel 9, stk. 4, sammenholdt med bilag IV, B, 6.a. og 7.b. ved under det offentlige udbud at anse tilbuddet fra Brønderslev Cementfabrik A/S for rettidigt indgivet.

9. I bilag III til tjenesteydelsesdirektivet er det i afsnit C, nr. 2, anført, at udbudsbekendtgørelsen skal indeholde en beskrivelse af tjenesteydelsen, og denne forskrift må forstås således, at udbudsbekendtgørelsen skal indeholde en præcis og fyldestgørende beskrivelse af den udbudte ydelse. I udbudsbekendtgørelsen var tjenesteydelsen angivet som »Totalrådgivning i forbindelse med udførelse af et dispositionsforslag samt 1. etape til en fuldt udbygget 2-sporet skole«, men det fremgår af udbudsvilkårene, at tjenesteydelsen tillige omfattede »Videreførelse af udbygningen med den fulde totalrådgivning i forbindelse med 2. etape« samt »videreførelse af udbygningen med den fulde totalrådgivning i forbindelse med 3. etape«. Da der så således er en ikke uvæsentlig uoverensstemmelse mellem angivelsen af tjenesteydelsen i udbudsbekendtgørelsen og den tjenesteydelse, som indklagede ønskede tilbud på, og som der senere blev indgået aftale om, har indklagede ved sin udbudsprocedure tilsidesat reglerne i tjenesteydelsesdirektivets artikel 17, stk. 1, sammenholdt med bilag III, afsnit C, nr. 2.
