Composition of the jury
The jury shall be composed exclusively of natural persons who are independent of participants in the contest. Indklagede har handlet i strid med Tjenesteydelsesdirektivets artikel 13, stk. 6, 1. og 2. pkt., ved at sammensætte dommerkomitéen med 9 medlemmer, uden at en tredjedel af medlemmerne af dommerkomitéen havde samme eller tilsvarende kvalifikationer som tilbudsgiverne, idet der kun var 2 sagkyndige medlemmer i dommerkomitéen.
K4. Indklagede har handlet i strid med Tjenesteydelsesdirektivets artikel 13, stk. 6, 1. og 2. pkt., ved at sammensætte dommerkomitéen således, at intet sagkyndigt medlem af dommerkomitéen havde samme eller tilsvarende kvalifikationer som de tilbudsgivere, som var rådgivende ingeniører. |
