Indklagede har handlet i strid med Tjenesteydelsesdirektivets artikel 13 og det EU-udbudsretlige gennemsigtighedsprincip ved at tillade, at dommerkomitéen lod tilbudene på honorar for ydelse af teknisk rådgivning og bistand indgå som et bedømmelseskriterium for beslutningen om udvælgelsen af det bedste forslag, uanset at indklagede ikke i udbudsbekendtgørelsen havde fastsat, at dette ville indgå som et kriterium for denne beslutning. |
